The Internet has many positive as well as negative aspects, since it also carries great danger because it is much easier to hind behind a false identity and commit illegal acts.Cybercrime presents a new challenge to legal systems, considering that the more individuals use computer, and the Internet, the more the interest of hackers and perpetrators to commit these types of crimes increases. There are multiple positive effects of internationalization of Higher Education (HE) on enriching students’ experiences in general and providing opportunities for exchange and development of all segments of university functioning. This paper aims to contribute to determining the role of institutional QA in promotion of the international cooperation in HE by analysing undergraduate students’ perceptions on their international experience and comparing them to their home University. Individual experiences of students from the Southeast European University (SEEU) in North Macedonia, who (...) participated in Erasmus exchange program in the last two academic years (2021/22 and 2022/23), with regard to the main quality assurance (QA) principles and measurements applied at their home University, are being considered. Their academic progress at the international universities is also taken into consideration. The aim is to collect firsthand information from the main stakeholders in the QA process about areas that can be further developed, as well as to position SEEU and self-check where it stands comparing and benchmarking it with some reputable European universities in order to better prepare its students for the international job market. SEEU has one of the most developed QA systems in the wider region, created and constantly being developed based on the international standards and guidelines and the long institutional experience. Thus, the paper also aims to contribute to defining some basic standards of internationalization of QA which would be recommended to the institutions from less developed, ITC (inclusiveness target countries) in order to assist them to place and welcome international students more successfully. This article aims to present the main findings of a small scale project developed with third year students of the Faculty of Law at South East European University regarding assessment of advocacy skills. The author who works as an assistant professor in the Faculty of Law has developed a pilot project aiming to create a new methodology on assessment. Advocacy skills represent the main learning outcome for law students in different universities. Oral assessment in faculties of law has evolved in (...) interesting ways thoroughly described in this article. The aim of this pilot project was to establish an objective and comprehensive methodology of assessment that includes oral presentations of case studies as well as oral assessment in the final exam. The author explains the challenges faced during the development of this pilot project and the creation of assessment rubrics. The author discusses the results of the project and gives an explanation of the way the project was developed and conducted. The conclusions and the recommendations given at the end discuss the importance of development of oral assessment techniques and provide certain insight information regarding the experience of teaching in the Faculty of Law. The author argues that oral assessment should be regarded as a very important asset which needs to be developed further with the aim of providing students the possibility to gain effective advocacy skills during their education. Criminal responsibility refers to a person’s ability to understand his action, behavior at the time a crime is committed, what a person is thinking when he commits a crime or the expected result when a crime is committed. Crime is defined in terms of an act or omission (actus reus) and a mental state (mens rea). In this paper, is presented the general concept of irresponsibility and essentially reduced responsibility as a reason to be exempted from the punishment provided by (...) the Criminal Code. Any perpetrator of a criminal offense who is capable of undertaking any action can be an active subject of a criminal offense, with the fact that regarding their sanctioning by the criminal system is concerned there are some restrictions related to age as well as dividing the perpetrators into responsible and non-responsible ones. For a person to be convicted of a crime, there must be evidence that proves his guilt, and that proves whether the perpetrator was in a regular state of mind or committed the criminal offense due to his irresponsibility. Another important element of this scientific paper is the historical aspects of how irresponsibility has been treated from the customary law to the present day, a huge focus gets also the treatment of the biological-psychological concept on one hand and the treatment of the legal concept on the other hand for this category of people. A criminal defendant who turns out to have been incapacitated at the time he committed a crime may be acquitted because of his incapacity, or he may be sentenced leniently because he was unable to understand the importance of his actions. Legally, the defendant must prove and convince the court that he was not able to understand his actions, or he is not able to distinguish right from wrong, or he must prove that he committed the act in uncontrolled impulses. Justice is not only about punishing the perpetrators but also protecting the rights of their victims. Corruption is not a victimless crime! Therefore, the main intention of this paper is to enlighten that protecting the rights of the victims of corruption is one of the crucial battles in the war against corruption. Wining this battle during the pandemic Covid-19 is grinding but of vital importance at the same time! Corruption has already been a remaining concern in the Republic of Kosovo. (...) Notwithstanding, the situation with the pandemic Covid-19 has made the justice system, and not only, more fragile. Consequently, we are currently living in a perfect environment for corruption acts where the victims of corruption are not acknowledged and sometimes even “garbled” with the victims of Covid-19! It is important more than ever to ensure effective remedies for persons who have suffered from corruption acts including the possibility of compensation for their damage. Indeed, the Republic of Kosovo is not a state party of the Civil Law Convention on Corruption. Yet this convention shall be the guide for establishing such legal avenues while the good practices of the United Kingdom and the French Republic shall be the aim and motivation for this. (shrink)

The purpose of this research is to study and address the relation between the perpetrator and the victim, in particular the way it is regulated in the Republic of Kosovo by comparing it with the regulation in other countries. A long time ago criminal law in its institutes has paid attention only to the perpetrator, trying to guarantee his fundamental rights, it is enough to stop at the institute of presumption of innocence and many other institutes and we can see (...) how importance criminal law and in particular criminal procedure has paid to the perpetrator, and on the other hand the victim has always remained in the shadows. Therefore, today we find it reasonable to address this issue, to find out from which period criminal law and authors of criminal law turn their heads towards the victim, to find out what is the position of the victim in society today, what steps have been taken in legal terms and also special attention will be paid precisely to restorative justice as a key point for the realization of the rights of the victim, the compensation of the damage and the restoration of balance and the establishment of relations in society. And it is quite important that in addition to the relations that perpetrators have with victims, we also try to understand the historical course of restorative justice and this way to make an analysis of the position of the victim and the perpetrator over the decades. Magna Carta Libertatum is one of the few documents that continuously imply thorough discussions about fundamental principles of the law. In 2011, Lord McNelly, Justice Minister of UK at the time, has emphasized the core and everlasting principles that derived from this document: ᠅ that the power of the state is not absolute ᠅ that whoever governs the state must obey the law ᠅ and that whoever governs the state must take account of the views of those who are governed. (...) These are the fundamental principles of any government that strives to be distinguished as democratic, these are the self-evident truths that have been developed in the theory of social contract that established the modern day democracies. It is very common that article 39 of Magna Carta that provides for the right to due process, as well as article 40 that provides for the right to access to justice and justice itself, to be usually analyzed from the point of view of the rights of the person accused of a crime. However, it must be taken into consideration, that failure to guarantee these two very important human rights makes the accused person a victim of abuse of power. This article aims to analyze the relevance of Magna Carta in the rise of the concept of rights of victims of abuse of power. Although it is a concept developed later in history, the clauses of Magna Carta that remain in power can be directly linked to this category of victims. The thirteenth century provides a very important perspective on the position of the victim of crime and can be analyzed in a comparative aspect regarding the Common Law and the Civil Law historical development. The article will briefly explain the evolution of the concept of victims’ rights throughout these eight centuries to the modern times when these rights have become a crucial part of the national legislations of Western Balkan countries. Presidential pardon has always existed in criminal law and continues to constitute a very important competence of the head of state in many modern day countries. In the past, the clemency given by the sovereign represented an act which showed his/her mercy upon their subjects. It was often used as a tool to show the arbitrary will of the sovereign that constituted the law, rather than the law itself. Therefore, the classical school of criminal law that appeared in the 18th (...) century and emphasized the importance of the principle of legality, opposed harshly every kind of arbitrary deciding that excluded the law at the interest of the sovereign. This school is among the only interpretations of criminal law that engages for a complete abandonment of institutes such as pardon or amnesty. The revolutionary French Penal Code of 1791, which was strongly influenced by the classical school, excluded clemency for the proved wrongs that were severely punished. However, due to imperfections of the criminal justice system, amnesty and pardon or clemency, continue to exist and to be used in modern day criminal law. They are no longer considered acts of arbitrary decisions of the sovereign, instead they should represent important instruments of criminal law, used rarely and wisely with specifically designed goals that aim to bring justice rather than deny it. However, there are many cases when these institutes have been inappropriately used in a very arrogant way which shows that the ancient regime is not yet over for some countries in which the highest institutions continue to act as old and middle age despots. This article will analyze the legal reasoning of the institution of presidential pardon. It will try to establish why the classical school was so strictly opposed to this institute making use of the studies and interpretations found in the writings of Cesare Beccaria. It will explain the philosophy of modern day institutions of amnesty and pardon and the way in which they are regulated in the legal theory and practice. The article will explain the recent developments in Macedonia in regard to the use of presidential pardon. The methods to be used consist of desk research, historical and comparative methods and analysis of legal texts, laws and judicial decisions. (shrink)

This paper provides a detailed analysis of how, according to Kant, the moral badness of some third parties’ actions can be established with certainty (by anyone, not only by the agent’s own conscience or by God). This account helps clarify why Kant affirms that some forms of wrongdoing (of which there are a “multitude of woeful examples”) can be demonstrated to be immoral, while excluding the possibility of proving the moral goodness of any action. This article explores Ruth’s theology of resilience amidst vulnerability: a resilience rooted in ḥesed. Ḥesed is a powerful social force that could address current issues for those both in privileged positions and in vulnerable situations. A re-reading of Ruth offers modern theologians and serious students of the Bible pathways towards building resilience amidst vulnerability, and in caring for those in vulnerable positions. The text at hand offers a pathway to be true to one’s core values and character, even amidst desperate (...) situations. In Ruth resilience is developed by caring for others, identifying with a particular faith community, and taking initiatives while maintaining integrity. The narrative unveils a sustainable life of resilience that happens when one’s private and public life is lived congruently to each other. This article also reads Ruth’s narrative through a lens of a minority foreign woman that uses feminist and post-colonial approaches while looking at Ruth through a hermeneutic of trust. First, the author identifies her assumptions and considerations. Secondly, the article examines resilience as rooted in one’s identity and explores ḥesed under cultural and spiritual frameworks, within the narrative of Ruth and Naomi’s road scene from Moab to Bethlehem. Lastly, it examines resilience as rooted in ḥesed, within the narrative of the threshing floor scene encounter between Ruth and Boaz. The road and threshing floor scenes are decisive moments for Ruth. Her words and actions in each instance reveal her resilience: her strength of mind, emotion, and spirit, in spite of her vulnerability. (shrink)

In this paper we develop Aristotle’s remarks about personal enmity (ἔχθρα) into a systematic account, with a view to determining whether personal enmity has a role to play in the good life. We argue that such an account can be obtained by examining Aristotle’s claims about hatred, and that this examination reveals that there is a significant place for enmity in Aristotle’s conception of the good life.

The AAR-SBL Women’s Caucus session on ‘Beyond Down and Dirty: From Good to Great Sex’ revisited the Good Sex: Feminist Perspectives from the World’s Religions project and book with the participation of two of its co-editors, Mary E. Hunt and Patricia Beattie Jung, and co-author and collaborator, Wanda Defeilt. Scholar colleagues, Brandy Daniels, Fitri Junoes, and Alicia Besa Panganiban, presented intriguing papers on feminist religious and ethical reflections on what constitutes great sex as they examined the issues discussed by (...) feminist scholars and activist authors of Good Sex. Moreover, the session was an exhilarating dialogue of international, interreligious, and intergenerational perspectives on what women think is great sex. It was an exciting starting ground for intergenerational discussion with senior scholars, associated with the Good Sex book, providing generous, constructive, and well-considered responses to the presentations of their colleagues. The diverse international audience of masters, doctoral and senior scholars – male and female – was included in the complex, fun, and challenging discussion of sex. Amidst various issues raised, there was a consensus that discussions on great sex must address issues of safety, justice, and pleasure. Overall the session was a success as the platform for the presentations modelled a feminist method that was intentionally designed to give more time for discussion, not only among panelists but also with the audience. Enterprise Resource Planning systems are used by universities to handle the academic services and business processes while providing enhanced experience and services to students. This study begins with a background review of ERPs in higher education institutions, the impact on the business processes through optimization and the importance of critical success factors for easier implementation. Secondly, Academic Planning, a core part of the student module of ERPs for higher education, is analyzed in this paper from the prism of data integration, (...) business process workflow, and process optimization. The issues that arise with development of a module are addressed through a case study at SEE-University. The data and business process workflows are based on an actual study by real implementation at this institution. The findings from this study will serve other universities who are in the process of implementation of an ERP to ease their development process and improve the efficiency of the services provided. Main contribution of this study is that it reduces the gap in literature and practice for issues and solutions that arise with the development of a new system, especially in higher education institutions, which in turn are very scarce in nature. This study aims to determine the demographic characteristics influencing the performance of Academic staff at the Southeast European University. This study employs data from the student evaluation carried out by the students for their respective professors and courses for the Fall and Spring semesters during the academic year 20/21. A lot of research has been done on demographics and its effect on the professor’s performance, and they point out that demographic attributes can change the rating evaluations, therefore these factors need (...) to be analyzed at SEEU to come to our conclusion. We assume that middle aged professors, females and single professors receive higher evaluation scores. In order to analyze the demographic characteristics of the academic staff of SEEU and how they influence student evaluations, quantitative research methodology was used including calculation of frequencies, percentages, means and cross tabulations. The results of the study show that students generally evaluate with high grades their professors, where the average of the whole questions asked resulted above 4.5, as per Likert scale, 1-5. Furthermore, the general results of the academic staff according to the demographic characteristics such as age, experience in teaching, academic title, gender and marital status for each academic staff do really show differences in student evaluation values. This is an important thing to know when recruiting and retaining academic staff that appear to be highly appreciated by students especially because that results from higher teaching quality. The use of student evaluations of teaching (SET) has become a widespread practice in higher education despite inconclusive evidence reported in the literature around its validity. Not surprisingly, the question of the validity of SET continues to be a current debate in higher education, pointing to the need for more research in this area. This paper is a part of a larger scale study, which aims to contribute to broadening the knowledge and understanding of SET validity by analysing the process (...) within the South East European University (SEEU) in North Macedonia in order to determine whether student evaluations are objective and critical. A likert scale questionnaire, containing 9 questions, was designed for the purpose of the analysis. The questionnaire was sent to all students from the five (5) Faculties: Business and Economics, Law, Contemporary Sciences and Technologies, Contemporary Social Sciences and Faculty of Languages, Cultures and Communications, in both campuses, Tetovo and Skopje. Three hundred and thirty three (333) students participated in the survey. Statistical Package for Social Science (SPSS) was used for analysing the results. Findings revealed that the information students received about the reputation, experience and qualifications of the professors had the highest influence on their perceptions, which in turn influenced the evaluations. As an addition, the present paper also compares two methods on a data set of actual SET. For illustrative purposes, only data from one faculty have been analysed. It is shown that the traditional method of considering the average values can misrepresent a teacher’s performance as it can be highly sensitive to any extreme grades, being either very positive or very negative. Online learning is becoming a commonplace in different settings starting from elementary, secondary and higher levels of education. Different educational institutions use different communication tools to promote learning because the expansive nature of the Internet and the accessibility of technology have generated a surge in the demand for web-based teaching and learning across the nations (Chaney, 2010). The online teaching and learning have become a necessity for education around the globe during COVID 19-pandemic. There are several challenges which are faced (...) during online classes because the students must have strong self-motivation skills and be very disciplined to achieve the desired learning results. This paper presents and analyzes the data on the benefits and challenges of online teaching at South East European University (SEEU) during COVID 19 pandemic. The participants of the study are students of the BA level majoring in English Language and Literature and German Language and Literature at SEEU in Tetovo, North Macedonia. To answer the research questions, we have used a student questionnaire, interviews, and student reflection papers written during the online courses. Overall, the research indicates that benefits of online coursework outweigh the challenges that students face during the online classes. From a safety perspective, this study emphasizes the need to consider the impact of online teaching on student motivation and the paper raises important questions about how to best support students enrolled in online courses. Further research is needed in order to better evaluate the benefits, challenges, and useful strategies of successful students enrolled in online courses. (shrink)

Everybody who has learned English as a second or foreign language knows that for reaching intermediate levels, English is an easy language regarding grammar and vocabulary; however, when reaching advanced levels, the learners are faced with complex forms of morphology, syntax, and most obviously, they are faced with the difficulties that pronunciation presents. These are mainly the problems that occur with the English students whose native language is other than English. An experienced teacher of non-native speakers of English can easily (...) recognize the causes of mispronunciation, which in most cases are lack of vocabulary, lack of practice, bad teaching experiences, lack of direct contact with the language, and lack of self-confidence. There are quite a lot of words in English, which are often mispronounced. Those who have just started to learn English as a foreign language, students at primary schools, adults using English as a means of communication and as a working tool, such as businessmen, politicians, administrators, doctors, accountants, and those studying English for teaching purposes, even the teachers of English are faced with the problems of proper pronunciation of words in English.The aim of this research is to identify the problems that the students in the Department of English Language and Literature in the Faculty of Languages, Cultures and Communication face with when they deal with pronunciation of lexical words. Learning through reflection is one of the most interesting experiences that students might have. It is considered a very good tool for self-assessing learning. It is believed that “teachers who promote reflective classrooms ensure that students are fully engaged in the process of making meaning”. Dewey was among the first researchers who based his work and research on the positive roles that reflection plays in fostering self-reflection and critical thinking. He has defined it as an active, persistent and careful consideration (...) of any belief. Reflections give students opportunities to think and reflect about their learning and note down the obstacles they might face during this process. The present study aims to investigate the impact of journal writing in promoting critical-thinking skills, and its impact on enhancing learning. The study uses two instruments, a student refection journal and an interview. Also, Marzano’s New Taxonomy of Educational Objectives developed in 2000 was used in the third phase of the study. This Taxonomy contains Three Systems: the Self-system, the Metacognitive system and the Cognitive system. The overall study results show that reflection journals help students to become more independent learners, reflect on their learning experiences and identify the most useful learning strategies. Most importantly, all study participants hold positive attitudes towards reflection and they consider it as a valuable tool which can increase learning. (shrink)

Die Begegnung mit Machiavelli in der Schweiz mag zwar, wie Richter (2005) es formuliert, kurz gewesen sein, aber sie war nachhaltig, und man kann nicht nur Kimpell (2009) zustimmen, die in Machiavellis Schriften Lösungen für (...) die Tocquevillesche Problematiken zu finden glaubt, sondern man kann auch mit Mansfield und Winthrop (2014) von einem Tocquevilleschen Machiavellismus sprechen. Auf jeden Fall geht es Tocqueville ebenso wie Machiavelli um die, wie Zuckert sie nennt, „effective truth“ (Zuckert 1991, 131), um die Welt, wie sie wirklich ist, und nicht, wie man sie sich ideal vorstellt. Im Juni 2005 wurde aus den verschütteten Kellern des verschwundenen Schlosses von Königsberg von russischen Archäologen eine silberne Schatulle mit Medaillen, Plaketten und einem Fingerring geborgen. Die,,rätselhaften" Bilder, Zeichen und Worte, die die Gegenstände tragen, leiteten den Berichterstatter der,dpa' in einer Pressemitteilung auf den Gedanken von Requisiten,,satanischer Rituale" sprechen zu können. Die hier vorgelegte Analyse der Bilder und Zeichenmotive kann den,,Hort" jedoch einem,,Gold- und Rosenkreuzer" als Vorbesitzer zuordnen. Auf diesem Geheimbund des 18. Jahrhunderts verweisen die neuplatonisch-hermetisch-gnostischen Züge der Sammlung, wie (...) sie in der Geheimgesellschaft thematisiert worden sind, insbesondere auch die astrologischen und alchemistischen Motive. Als Rosenkreuzer, der zugleich Verbindungen zum Preußenschloß in Königsberg besaß, kommt als Besitzer der Medaillenkollektion allein Friedrich Wilhelm II. in Betracht, Nachfolger Friedrich des Großen auf dem preußischen Thron. Die Kulturwissenschaften besitzen ein Interesse an einer positiven inkompatibilistischen Antwort auf die Frage nach der Freiheit des Willens. Wäre es nicht möglich, einen gehaltvollen inkompatibilistischen Begriff von Willensfreiheit zu entwickeln, besäßen die Kulturwissenschaften einen gegenüber den Naturwissenschaften defizienten Status in dem Sinne, dass ihre hermeneutische Vorgehensweise nur provisorischen Wert hat, solange bis eine verlaufsgesetzliche Erklärung des je betreffenden menschlichen Verhaltens etabliert ist. Im Beitrag wird zunächst der Begriff der Willensfreiheit diskutiert. Im Anschluss daran wird zum einen der deterministische Versuch widerlegt, (...) die Existenz einer (inkompatibilistisch bestimmten) Freiheit des Willens zu negieren und zum anderen aber auch die übichen antideterministischen Verteidigungsversuche als unzureichend ausgewiesen. Etwa im Jahre 1833 verfasst Heinrich Heine einen kurzen, Fragment gebliebenen Essay Verschiedenartige Geschichtsauffassung, in dem er zwei Interpretationen des historischen Geschehens einander gegenüberstellt: Die Anhänger der einen legen dieses als „trostlosen Kreislauf” aus, in dem sich alle Vorgänge und Prozesse wie Jahreszeiten wiederholen, die Anhänger der anderen Geschichtsdeutung, „die mehr mit der Idee einer Vorsehung verwandt ist”, geben sich der Täuschung hin, als würden „alle irdischen Dinge einer schönen Vervollkommenheit entgegenreifen”. Obwohl Heine an beiden Auffassungen Kritik übt, bekennt er (...) sich doch selbst zehn Jahre später zu ebenso utopischen Ideen, indem er die künftige „Emanzipation des Fleisches” und den Anbruch einer „Demokratie gleichherrlicher, gleichheiliger, gleichbeseligter Götter” verkündet, d. h. einer neuen, glücklichen, sich selbst vergottenden Menschheit, die sündenlos das Leben und alle seine Freuden genießen soll. Diese naiven Vorstellungen verwirft er allerdings schnell und warnt nun als einer der ersten vor den Gefahren der anbrechenden kommunistischen Utopie. Offen bleibt bis heute die Frage, inwieweit Heines Essay auch Friedrich Nietzsche und dessen Idee von der „Wiederkunft des Gleichen” beeinflusst haben mag. Auch wenn Nietzsche hier mit Sicherheit aus verschiedenen Quellen geschöpft hatte, lässt sich doch nicht ausschließen, dass Heines Essay die Rolle einer Art Katalysator hätte spielen können, zumal nachgewiesen ist, dass er Adolf Strodtmanns Ausgabe von Heines Letzten Gedichten und Gedanken aus dem Jahre 1869 in seiner Bibliothek besaß. ZUSAMMENFASSUNGTroeltschs Konzept des »Neuprotestantismus« wird als Exemplar der für das Christentum aller Zeiten wesentlichen Besinnung auf seine im geschichtlichen Werden erreichte Gegenwartslage betrachtet. Dabei kommen die Stärken des Konzepts, aber auch seine Unklarheiten und systematischen Schwächen in den Blick. Die Stärke des Konzepts ist die Betonung des Bruches des gesamtgesellschaftlichen Kontextes, in dem das protestantische Christentum an der Wende vom 19. zum 20. Jahrhundert existiert, gegenüber den sozialen Kontexten seiner Entstehung und ersten Entfaltung im 16. und 17. Jahrhundert. Die Unklarheiten (...) des Konzepts betreffen die Frage nach den entscheidenden Wirkfaktoren und Urhebern dieses Bruches. Diese Unklarheiten ergeben sich aus den Schwächen des Konzepts. Diese liegen auf der Ebene der die Geschichtserkenntnis und die Geschichtsschreibung leitenden Kategorien, die keine angemessene Wahrnehmung derjenigen Kontinuitäts- und Identitätsmomente ermöglichen, die von jeder Diskontinuitätswahrnehmung und -behauptung faktisch immer schon vorausgesetzt werden. Dieser Mangel erweist Troeltschs Anspruch, nur die Christentumstheorie Schleiermachers fortzuschreiben, als unhaltbar. Vielmehr bleibt Troeltschs Position hinter der Schleiermacherschen zurück, weil ihr diejenigen epistemologischen und ontologischen Einsichten fehlen, welche Schleiermacher besaß und welche es für Schleiermacher möglich machten, alle Phänomene der Christentumsgeschichte und die zwischen ihnen waltende Diskontinuität im Horizont des Wesens des Christentums und seiner Identität-in-der-Geschichte aufzufassen. Dadurch ist Schleiermacher in der Lage, das Christentum, auch in seiner protestantischen Ausprägung, als einen in den jeweiligen geschichtlichen Verhältnissen widerstandsfähigen und bildungskräftigen Faktor zu denken. Demgegenüber führt der Ausfall der Erkenntnis und Anerkennung des Wesens des Protestantismus und seiner Identität-in-der-Geschichte bei Troeltsch dazu, dass hier der Protestantismus überwiegend nur noch als Produkt der Verhältnisse in den Blick kommt. Nicht die Position Schleiermachers, wohl aber diejenige Troeltschs gehört daher in den Prozess der Selbstsäkularisierung des Protestantismus.SUMMARYTroeltsch's concept of “neo-Protestantism” is regarded as an example of reflection – essential to Christianity of all times – on the present situation of Christianity which is achieved through a process of historical becoming. Such a form of reflection is characteristic of Christianity throughout its history. Thereby the strengths of the concept come into view, but also its opacities and systematic weaknesses. The strength of the concept is the emphasis on the breach in the entire social context in which Protestant Christianity existed at the turn from the 19th to the 20th century, compared to the social contexts of its origins and the first stage of this disruption in the 16th and 17th century. The ambiguities of the concept relate to the question of the decisive influences and originating factors of this breach. These uncertainties arise from the weaknesses of the concept. These lie at the level of historical knowledge and of leading categories of historiography which do not make it possible to perceive continuity and moments of identity which are, in fact, always presupposed in the perception of discontinuity in history. This proves that Troeltsch's claim to carry forward Schleiermacher's theory of Christianity must be seen as untenable. Because of its missing epistemological and ontological foundations Troeltsch's view remains inferior to that of Schleiermacher. On the basis of such epistemological and ontological foundations Schleiermacher was able to interpret the phenomena of the history of Christianity and its discontinuities in the horizon of the essence of Christianity and its identity in history. Therefore Schleiermacher is able to conceive of Christianity also in Protestant form as an active factor in its respective historical circumstances which is able to function both creatively and critically in relation to external factors. In contrast, Troeltsch can only conceive of Protestantism as the product of external circumstances. It is the position of Troeltsch, not that of Schleiermacher, which is part of the process of self-secularization in Protestantism. (shrink)

Francesco Petrarca ist heute fast ausschließlich als Verfasser des Canzoniere bekannt, mit dem er für Jahrhunderte die europäische Liebeslyrik geprägt hat. Seinen Zeitgenossen und anscheinend auch ihm selbst galten jedoch seine lateinischen Werke - das Epos Africa, die Viten, die moralphilosophischen Schriften, Invektiven und Briefsammlungen, in denen er die wechselnden Fragen des privaten und öffentlichen Lebens reflektierte - höher; in ihnen fand nicht nur die italienische Umwelt, sondern auch noch ein Jahrhundert später die europäische Nachwelt den Philosophen, der angesichts der (...) Ausweglosigkeit spätmittelalterlicher Scholastik neue Wege zu einem dem Menschen gemäßen Selbst- und Weltverständnis wies. Eckhard Keßlers Untersuchung, die mit dem Premio Montecchio ausgezeichnet wurde, stellt Petrarca in den Kontext der Spätscholastik und zeigt, dass er, gerade weil er die Probleme der spätscholastischen Philosophie ernst nahm, zum exemplarischen Wegbereiter neuzeitlichen Denkens geworden ist. "Eckhard Keßler hat in Petrarca und die Geschichte wie keiner zuvor herausgearbeitet, daß die Prozesse der Säkularisierung als Kern jeder Geschichte der Neuzeit zum ersten Mal von Petrarca nach eigener Erfahrung beschrieben und in ihrer Konsequenz durchdacht worden sind. [.] Petrarcas Auffassungen von einer notwendigen Säkularisierung sind seit dem Ende des 18. Jahrhunderts völlig aus dem Bewußtsein der politischen Philosophen und künstlerischen Verweltlicher ausgeblendet gewesen; auch Schlegel und seine Zeitgenossen besaßen von Petrarcas Leistungen nicht einmal eine Ahnung. Daß die politische Theologie, die politische Philosophie, die politische Poesie gegenwärtig nicht nur in fernen Theokratien Konjunktur haben, sondern auch bei uns herbeigesehnt werden, sollte uns für Petrarcas Alternativen interessieren. Qaṣeeda-i Burdah written by Egyptian sufi poet Busīrī (d. 695/1296) as an eulogy for Beloved Messenger Moḥammed has received great attention in the Islamic world. This work has been recited both in cultural/social ceremonies such as weddings, holidays and funerals. On the other hand, it was also annotated, translated, and takhmīs, tesdīs, tesbī‘ and taşṭīr were written to it by the pen of scholars and litterateurs in literary circles. These activities, which have been carried out over and over again, has (...) been going on from the 15th century to the present day. Not only the reputed people, but also unknown ones or ones whose names were later forgotten have tried to translate it to their own language. The subject of the study is one of this type of poetic translations of the eulogy. Like its translator, date of this poetic translation is also unknown. This work was written in the remel baḥr type of ‘arūż in 162 verses using the spelling of the classical period. Although a significant portion of the rhyme words was adapted from the source text, it has a more understandable style than its counterpart. In terms of poetry, it is above the average. The translator decorated the meaning that he borrowed from the original text with his own poetic ability and tried to express it in a unique manner. For this aim, it is more literary, lyrical and successful than most other translations of Qaṣeeda-i Burdah. In the present study, text of the mentioned work was given with transcription along with mentioning of some of its features. Summary: Qaṣeeda-i Burdah written by Egyptian sufi poet Buṣīrī (d. 695/1296) has an important place in the Islamic world. Named by the poet himself as al-Kavākib-al-durriya fī madḥi khayr-al-bariyya, this work is also known as al-Qaṣeedat-al-mīmiyya since its rhyme letter is Arabic mim, as Qaṣeeda-i Bur’ah since it caused Buṣīrī to recover from a disease, as Qaṣeeda-i Burdah due to the rumor that this event took place while he was wearing a coat by the hands of Beloved Messenger Moḥammed. In order to prevent confusion with the eulogy of Ka‘b b. Zuhayr (d. 24/645) with the same name, it is known in cultural circles as Qaṣeeda-i Bur’ah. However, in literature, it is commonly referred as Qaṣeeda-i Burdah. The work was written in simple baḥr style of ‘arūż, and consists of 161 couplets. It has ten sections in terms of its content: longing for the beloved, complaining about the soul, eulogy for Beloved Messenger Moḥammed, his birth, miracles, dignity of the Holy Qur’ān, miracle of mi‘rāc, importance of jihad, sorrow, hope, prayer and request. The eulogy, which has an effective style, has gained great acclaim in the Islamic geography and has been read for various purposes for centuries. Some people recite it in wedding ceremonies, while some others use it in funerals. The sick people recite it with the hope of healing, while calligraphers wrote it for practice.Owing its fame more to its story rather than its value of art, the eulogy was translated into Eastern languages such as Persian, Malay, Pashto, Punjabi, Turkish and Urdu, as well as into Western languages such as German, French, Greek, English, Spanish, Italian and Latin. In addition, many annotations, footnotes, takhmīs, tesdīs, tesbī‘, taşṭīr and replies were written to it. For example, the poem annotated in Arabic by Ebū Shāme al-Maqdisī (d. 665/1266), Khalid b. ‘Abdullah al-Ezherī (d. 905/1499), Ibrahim b. Moḥammed al-Bacurī (d. 1277/1860), ‘Omer b. Aḥmed al-Ḥarpuṭī (d. 1299/1882) was translated into Persian by the men of letters such as Molla Ḥafıẓ Sharaf (d. after 810/1407), ‘Iṣāmuddin b. ‘Arabshah al-Isfarayinī (d. 945/1538), ‘Ali b. Ḥasan Zavareī (d. 968/1560). The work was annotated by Le‘alī Aḥmed b. Muṣṭafa (d. 971/1563), Sayyid Ḥasan b. ‘Abdurraḥman (d. 1071/1661), Naẓifī Ismail Aqḥiṣarī (d. after 1205/1790), Shaykh-al-Islam Makkī Meḥmed (d. 1212/1797), Moḥammed b. The present study deals with such a translation of the work. To our best knowledge, the translation that has not been paid much attention by scholars to date and was mentioned only by Ṣadıq Yazar. Even he articulated only a few sentences about the translation based on a deficient copy of the work. Both in the library records and in its copies, there was no information about the translator and the translation date of the work. The translation, which beginns directly without a section such as an introduction at the opening, was written in 162 verses with the spelling of the classical period. It has a remel baḥr style of ‘arūż structure with fā‘ilātun fā‘ilātun fā‘ilātun fā‘ilun rhythm. Although it has some ‘arūż mistakes, it can be said that it is successful in terms of rhythm. Using the source text rhyme of mīm letter, the translator directly adapted some rhyme words from the Arabic text, while converting some others to appropriate Turkish words. Although he used some of them only once, he used some others several times. This finding implies that the translator may have had difficulties in finding words for the rhyme. It is noteworthy that he used some of those words in different meanings, and he employed 99 different rhymes in 162 couplets. The translator used the original text for purposes other than the rhyme words. He used some words directly without translating them or only removed the ḥarf-i ta‘rif. He transformed some words to others with the same stem or to their counterparts in Persian. While converting some of the phrases to forms suitable for the structure of the Turkish language using various practices, he used the old Anatolian Turkish as well as living Turkish. Like Buṣīrī’s eulogy, the poem, which consists of 10 parts in terms of contents, is suitable for the contents of the source text, but it is not a literal translation. The translator, who cared about literary rhetoric, largely preserved or even contributed to the harmony elements of the text. He reinterpreted the meaning of Buṣīrī’s work using his poetry skills, and produced a successful translation in terms of poetry with minimal rhyme flaws. Considering other translations of Qaṣeeda-i Burdah, the translation has similarities with that by Uskudarlı ‘Abdulhay Jalvatī in terms of rhyme letter, with that by Sayyid Husayin Amasī in terms of rhyme, and with that by Ismail Mufid Afandi in terms of direct adaptation of some words in original text, while it has common characteristics with the translation by Naḥifī in terms of both rhyme letter and direct adaptation of most rhyme words from the original text. On the other hand, the translation has similarities with the translations by Kemal Pashazāde, Ahmed-i Rıḍvan, Esasī Afandi, ‘Abdullah Ṣalaḥī and Na‘imī in terms of rhyme letter, rhyme and adaptation of most rhyme words from the original text. However, it is simpler compared to the translation by Kemal Pashazāde, more loyal to the content of original text compared to the translation by Ahmed-i Rıḍvan and more robust in terms of rhyme compared to the translation by Na‘imī. Er konnte Homer auf Griechisch und Cicero auf Lateinisch zitieren, lernte als Oberschüler Hebräisch, und die Propheten waren ihm lieb«. Schon das legt nahe, bei der Rekonstruktion der konzeptuellen Gesamtheit von Jonas’ Werk seiner Beziehung zum klassischen Erbe einen privilegierten Ort zu reservieren. Antalya, which is today’s attraction center with its historical and natural beauties, was described as “a city like heaven” since ancient times. This city hosted many civilisations and states until the 13th century and became an important seaport after The Seljuks took over the region. The Seljuks applied civilization and urbanization policy also in Antalya, like other regions they ruled. The mosques, madrasahs (Islamıc theology institutions), schools, baths, caravansearis (hostels), hospices, and water cisterns in this period changed the structure of (...) the city and paved the way for improvements of public life. During the Ottomans some of these social institutions were kept active while the others no longer served to the public. However, with the construction of new social institutions, urbanization was resumed. The madrasas were generally built near or adjacent to the mosques, and had a significant role in developing the society and cultural structure. Although the madrasas in Antalya were mainly the institutions that maintain the education system, the research on these madrasas mostly focuses on their architectural features. The majority of these madrasas that are not comprehensively studied. Therefore, the functioning structures and the problems of Antalya Madrasas (Antalya, Korkuteli and Elmalı), which are reflected in the archive documents between the 17th and 20th centuries and also both individuals and institutions that had influence on these madrasas are going to be investigated in this study. Thus, this paper will shed more light on Antalya Madrasas.Summary: Antalya city, which was completely under the Seljuk sovereignty during the reign of Sultan Alaeddin Keykubat I (1219-1236), was named as Alâiyye dedicated to the Sultan's name and became an important port city of the Seljuk State after then. In the process of the fall of the Seljuk State and the beginning of the Emirates (Beylikler) period, the city became a land of Teke-Oğulları, a part of a Hamid-oğulları, and in 1390 the city became an Ottoman city after the struggle of Yıldırım Bayazid with Teke-oğuları. Antalya was home to the madrasahs, one of the formal education institutions during both the Seljuk and the Ottoman Empire. The madrasahs were built next to the mosque or in a detached area built by sometimes administrators or statesmen, sometimes by members of the dynasty or by the citizens who were wealthy. In Antalya, both single floor and second floor madrasahs were built. This study based on the documents from Prime Ministry Ottoman Archive, the travel books of İbn Bibi and Evliya Çelebi, the works on Antalya Madrasahs to be determine the madrasah in the districts of Antalya as Korkuteli and Elmalı. In addition to the Seljuk madrasahs such as Imaret Madrasah, Atabey Armagan Madrasah and Karatay Madrasah, there are also some madrasahs belonging to the Ottoman period, in Antalya. As a matter of fact, the madrasahs increased in number in the period of the Ottoman. Antalya madrasahs which are reflected in archival documents for any reason are as follows: “Süleyman Madrasah” located in Hatip Süleyman Street, “Madrasah built by Haci Mahmed” located in Elmali Street, “Hacı Abbaszâde Hacı Süleyman Madrasah” in Süleyman Street, “İsmail Efendi Madrasah” in Tahtapazarı Kızılsaray Street, Kasab Hacı Ahmed Madrasah, Hacı Cafer Ağa Madrasah, Murad Ağa Madrasah, Esir Hacı Ali Madrasah, Hacı Hasan Madrasah,“Madrasah built by Hasan Efendi” in Keçiyalar Street, in the Kadılar Street of Gediz County “Madrasah built by Yusuf Efendi”, “Madrasah built by Hızır Efendi” in Cami-i atik Street, Murat Pasha Madrasah, “Sefer Ağa Madrasah” located outside the city wall, “Büyülü Minaret Madrasah, Hatuniye Madrasah, Sheik Sinan Camii Madrasah located outside the city Wall, In addition to these madrasahs mentioned in some studies in Antalya, it is also stated that there are madrasahs such as Müsellim Madrasah, Kesik Minaret Madrasah, Karakas Madrasah, Varsakli Mehmet Efendi Madrasah, Meydan Madrasah, Surmeli Madrasah, Canmülk Madrasah, Ahi Kız Madrasah, Hacı Naim Efendi Madrasah, Susam Madrasah, Çömlekçi Madrasah, Değirmenönü Madrasah, Ak Mescid Madrasah, Âşık Doğan Madrasah and Çukur Madrasah.According to archive documents, in the sub-district of Antalya, which is used as a plateau or plateau area, some madrasahs were recorded as follows: Pınarbaşı Madrasah, Hızır Efendi Madrasah, Mustafa Efendi Madrasah, Emir Sinaneddin Madrasah, Hacı Menlü (Mevlüt) oğlu Ömer Medrese, Abu Bakr Agha Madrasah, Koca Hafız Medrese, Hacı Mollaoğlu El-Hac Ömer Madrasah, Sheikh İsmail Efendi Madrasah. However, Süleyman Fikri Erten, who works on Antalya, stated that the number of madrasahs is eight as: Haci Ahmet Madrasah of Kalkanlı, Sultan Hatun Madrasah, Koparanzade Hacı Hüseyin Madrasah, Karabayırlı Hacı Hüseyin Madrasah, Kaşlı Ali Efendi Madrasah, Hacı Hüseyin Madrasah, Şalaka Ahmet Madrasah and Oyunyeri Madrasah.The madrasahs built in Elmalı, another distict of Antalya, were as follows: Ketenci Ömer Paşa Madrasah, Esbak Mir-i Ahur Hacı Mehmet Bey Madrasah, Haydar Baba Madrasah, Arifî Ahmed Paşa Madrasah, Hüseyin Efendi Madrasah, Debbağ Baba Madrasah, Şeyh Ümmi Sinan Madrasah, Babazade Hacı Abdurrahman Madrasah, Hacı Şeyh Efendi Madrasah, Mustafa Efendi Madrasah, Hasan Efendi Madrasah, Salih Efendi Madrasah, Halil Efendi Madrasah, Çankırlı Madrasah, Osman Efendi Madrasah and “Mehmet Efendi Madrasah in Örtekiz village”. In addition, two madrasahs, except from these, were also found in the archive documents.A madrasah was built almost at every Street of Antalya and the madrasahs were usually named by the name of their builders. Madrasah students were provided with a certain amount of scholarship to continue their education according to the level of the education in the madrasahs and the level of the courses taught, salaries of the scholars, the status of the builder of the madrasah. The scholars who worked in the madrasahs worked with a document called berat-i sharif and in the case of the disappearance of this document a new berat-i sharif would be prepared by the Shaykh al-Islami. Scholars working without this document were also determined. In the scholar appointments foundation, board of trustees, müfti, and the city regents were very influential. There were also some appointments resulted from death, promotion besides leaving job with their own will. There were some problems with the appointments in Antalya and the foundation revenues to which the madrasah was attached were delivered to certain individuals until these problems were resolved.In madrasahs of Antalya, science was given a great importance and all kinds of monetary issues were tired to be eliminated with donations given to both scholars and students. However, it is observed that madrasahs were involved in some events in Antalya. As a matter of fact, among those who participated in the Şah Kulu Rebellion that took place in 1510-1511, there were also madrasah students and education training had therefore been disrupted for a long time. it is known that the state sent orders to the judges (qadi) in the region consecutively in order to prevent the rebellion. Also during this period some madrasahs were used as the activity center of armed students or people who disguised them.One of the issues that negates the education and training in the madrasahs in Antalya is that in 1890 the immigrants started to be hosted in Antalya and the guests visiting were accommodated in madrasahs as there were no other available places. This situation had been continued for a long time and even telegrams have been sent about the students living on the sidewalks.Another important issue that disrupts education was epidemic diseases. It was reported that too many people died in the district of Istanoz because of smallpox, there was no doctor and the health personnel should go to the region urgently. Despite all the problems experienced in madrasahs, they continued their activities in Antalya and while continuing their activities under the control of foundations in 1826, with the establishment of the Ministry of Foundations, they were connected to this institution. Die kirchen- und dogmengeschichtliche Forschung hat die Beschäftigung mit der Geschichte der Christen im mittelalterlichen Nahen Osten lange vernachlässigt. Für die Zeit nach 700 reduzierte sich Kirchengeschichte in den meisten einschlägigen Handbüchern weitgehend auf die Darstellung der Entwicklung der abendländischen Kirche. Abgesehen von griechischen, russischen und arabischen Arbeiten, die schon aus sprachlichen Gründen meist wenig Beachtung fanden, beschäftigten sich nur wenige Abhandlungen von Spezialisten, die Kenntnisse der orientalischen Sprachen besaßen, mit der Geschichte der einheimischen Christen des Nahen Ostens nach dem (...) 7. Jahrhundert. Erst seit neuester Zeit sind mehrbändige Darstellungen der Kirchengeschichte greifbar, die auch die Geschichte der östlichen Kirchen in befriedigender Weise miteinbeziehen. Wie der von Pahlitzsch in der Einleitung (S. 13–18) gegebene Überblick über den Forschungsstand zeigt, ist jedoch in den letzten beiden Jahrzehnten auch eine Zunahme der wissenschaftlichen Beschäftigung mit der Kirchengeschichte und der gesellschaftlichen Situation der griechisch-orthodoxen Melkiten in den Kreuzfahrerstaaten zu beobachten.
